Refund and Returns Policy

This Return and Refund Policy outlines the terms under which refunds or replacements may be issued for services rendered. Please read this policy carefully before engaging our services.

1. Overview

As a service-based agency, NEXCRUITA does not offer refunds in the traditional sense applicable to physical goods. However, we are committed to ensuring client satisfaction and maintaining the highest standards in recruitment and staffing. If a client is dissatisfied due to specific, legitimate, and verifiable service-related issues, we may, under certain conditions, offer a replacement candidate or a partial/full refund based on the nature of the grievance and internal evaluation.

2. Candidate Replacement Guarantee

We understand that hiring the right talent is critical. Therefore, if a candidate referred or placed by NEXCRUITA fails to meet expectations, leaves the job voluntarily, or is terminated due to performance issues within a specified period, we offer a candidate replacement under the following conditions:

  • For Permanent Placements: If a candidate leaves or is terminated within 90 days from the date of joining, NEXCRUITA will provide a one-time replacement at no additional cost, provided that:
    1. The client has paid the agreed service fee in full.
    2. The job description and requirements initially provided have not changed.
    3. The reason for the candidate’s exit is not due to downsizing, restructuring, or external factors beyond the candidate’s control.
  • For Contract Placements: Replacement within the initial 30 days of assignment may be considered if the candidate’s performance is unsatisfactory or if they breach the terms of the contract.

3. Refund Eligibility

Refunds are rare and considered only when all reasonable attempts to resolve the issue have been exhausted. A refund request may be considered valid in the following scenarios:

  • NEXCRUITA fails to present suitable candidates within a mutually agreed timeline.
  • The candidate placed is found to have falsified credentials or misrepresented critical qualifications, and this was not disclosed or discovered during the vetting process.
  • The replacement guarantee has been invoked, and NEXCRUITA is unable to find a suitable replacement within 30 business days.

Refunds will be issued based on the following considerations:

  • The proportion of service rendered at the time of the issue.
  • The client’s cooperation during the recruitment process.
  • The reason for the request and supporting documentation.

Note: Refunds are not applicable in situations where:

  • The client changes the job requirements mid-process.
  • The client rejects all recommended candidates without justifiable reason.
  • Delays are caused by lack of communication or responsiveness from the client.
  • The hiring failure is due to internal company restructuring or budget changes.

4. Refund Process

If eligible for a refund, the following steps will apply:

  • The client must submit a written refund request stating the reasons, along with all relevant documentation and correspondence.
  • NEXCRUITA will conduct an internal review to validate the claim.
  • If approved, the refund will be processed within 15 to 30 business days, and the amount will be credited via the original payment method unless otherwise agreed upon.

5. Non-Refundable Fees

Certain fees are non-refundable, including but not limited to:

  • Initial consultation or engagement fees.
  • Advertising or job listing expenses.
  • Background checks or third-party verification costs already incurred.
  • Custom testing, screening, or assessment costs completed at the client’s request.

6. Service Interruption or Cancellation

If a recruitment project is cancelled by the client after engagement and work has already commenced, a partial refund may be considered, taking into account:

  • The volume of work completed at the time of cancellation.
  • Resources already committed to the project.
  • Time and effort expended in candidate sourcing, vetting, and communication.

In such cases, NEXCRUITA reserves the right to retain a portion of the payment to cover operational and administrative costs.

7. Dispute Resolution

In the event of a disagreement regarding refunds or replacements, both parties agree to make all reasonable efforts to resolve the issue amicably. If a mutual agreement cannot be reached, the matter may be escalated in accordance with the governing terms outlined in the service contract or agreement signed prior to the engagement.

8. Policy Modifications

NEXCRUITA reserves the right to modify or amend this Return and Refund Policy at any time without prior notice. Any changes will be updated on our official platforms and will take effect immediately upon publication. Clients are encouraged to review the policy periodically to remain informed of any changes.

9. Acknowledgment and Acceptance

By engaging NEXCRUITA’s services, clients acknowledge that they have read, understood, and agreed to the terms set forth in this Return and Refund Policy. This policy serves to protect both parties and ensures that all recruitment engagements are conducted fairly and professionally.
